COMPASSIONATE RELEASEWhat is a Compassionate Release?Under 18 U.S.C. 4205(g) and 18 U.S.C. 3582(c)(1)(A), a sentencing court, on motion of Bureau of Prisons(BOP), may reduce the term of imprisonment in particular if there are extraordinary or compelling circumstances which could not have been foreseen by the court at the time of sentencing. The initial request for compassionate release must be made in writing to the BOP on the inmates’ behalf. After review of the request by the Warden, the Regional Director, the General Counsel, either the Medical Director for medical referrals or the Assistant Director for non-medical referrals, the request is either approved or rejected. All members must be in accord for you to be approved for a motion request. A complete packet of information, (including, but not limited to, medical records, prison progress reports, etc.) must be submitted at the time of initial request to be reviewed by deciding officials. Approvals are obtained individually in the order listed above. Denial by Warden or Regional Director may be appealed. Denial by the General Counsel or BOP constitutes a final administrative decision. Once your request is approved by the Director of BOP, the Director will contact the U.S. Attorney regarding moving the sentencing court on behalf of the BOP to reduce the inmates’ term of imprisonment to time served. Once the sentencing court has granted the motion, under 18 U.S.C. 4205(g), there is an inmate hearing scheduled on the earliest Parole Commission Docket.
