AMENDMENT 711: RETROACTIVE “CRACK” AMENDMENT

You may be eligible for a significant reduction in your federal prison sentence, if your conviction involved a “crack” cocaine or “cocaine based” offence. How, you ask? Lifeline has information you can use.

Amendment 706 (“Crack” Amendment), effective November 1, 2007, and Amendment 711 (Retroactive “Crack” Amendment), effective March 3, 2008, will affect 70% of “crack” cocaine cases sentenced by the federal courts, significantly reducing imposed sentences.

Unfortunately, Amendment 711 will not automatically reduce your sentence. A motion must be filed on your behalf requesting such reduction in sentence. Recommendations can be made by the Bureau of Prisons (BOP) or the original sentencing court; however, this is highly unlikely.

Do I qualify? If you are serving a mandatory minimum sentence, sorry, these may only be amended by Congress. If you are documented as a “career or armed career offender,” or if the imposed sentence involved another illegal chemical substance, like “meth,” then unfortunately, you may not be eligible under Amendment 711 guidelines. If you find that you may be eligible for Amendment 711, a motion must be filed on your behalf, as stated above, in conjuncture with a host of other paperwork. Consideration for Amendment 711 will be initially limited to those who have filed a request. The Clerks Office will typically docket motions with the original sentencing judge. In the absence of the original sentencing judge, the Chief Judge presides. The relevant paperwork must be filed efficiently; otherwise, the case will be overlooked. Understand that this process does, however, take patience. Counsel for the government has 20 days to respond to the motion filed on your behalf. After consent and or any objections have been filed with the court, the case is submitted to the court for evaluation. Keep in mind, the outcome of your case is based on the discretion of the presiding court. Rest assured, presentation and accuracy is key in most cases.
