What is Executive Clemency?

It is the power of, the President in federal criminal convictions, and the Governor in state criminal convictions, to pardon a person convicted of a crime, commute (shorten) a sentence, often to time served, or reduce a sentence from death to a lesser term.

What is a pardon?

It is the action of the President or Governor that mitigates (soften, lighten) or sets aside the punishment for a crime. There are two types of pardons, conditional and unconditional. The granting of an unconditional pardon fully restores the civil rights forfeited upon conviction of a crime and restores a person’s innocence. A conditional pardon imposes a condition on the offender before it becomes effective. Typically, this means to commute the sentence. For example, the President has the power to mitigate a death sentence on the condition that the accused serve the rest of his or her life in prison without the eligibility of parole.
