PRESENTENCE ASSESSMENT REPORTWhat is a presentence report and why is it important?A presentence report, otherwise called presentence investigation report or (PSI), is a document prepared by an officer of the PSI division of the Federal Probation Office. This document contains information gathered by the officer through a thorough background investigation and can often include extensive interviews with you, your family and sometimes even members of your community. It usually consists of about 30 pages of the defendant’s educational, financial, community, and family background. It will also contain a complete criminal history which will weigh heavily on the sentencing table used to calculate points relevant to statutory sentencing, also included in the report. Upon completion of the investigation, the probation officer gives the judge a sentence recommendation based on his/her assessment of the case. The PSI demands careful attention from the defendant, as this is the report the judge uses to determine how you will be sentenced and where you will serve out your sentence in the crime you have been convicted of. Rule 32, of the Federal Rules of Criminal Procedure is what governs the presentence investigation. It was mandated to assist the sentencing judge in evaluating the offender as a person, despite the crime he/she is convicted of.
