EXPUNGEMENT OF A CRIMINAL RECORD

Get your criminal record expunged. Expungement is the sealing or removal of criminal records. Each state has its own definition of expungement, based upon their statute (state specific laws). In general, expungement can be viewed as the process to “remove from general review.” However, the records may not disappear completely, and may still be accessible to law enforcement. Also, if you plan to apply to any public office, you may be required to fully disclose a complete criminal history. Some government regulated professional license applications may also require full disclosure.

How do I know if I am eligible?

Eligibility is based on statue. Quite often there are numerous conditions set forth, that must be met before a request is considered, including but not limited to;

• A minimum length of time has passed since arrest
• There have been no subsequent arrests
• The proceedings were dismissed
• Acquittal
• Discharge without conviction
• Release without formal charges being filed
• Any juvenile records have been previously expunged

Is there a risk of denial?

Yes. Each state has its own statue. Some contributing factors in a denial include and are not limited to any non-compliance to the above criteria, as well as;

• An outstanding balance of any fines imposed by an offence
• Additional convictions
• Previous expungement
• Pending arrests
• Conviction of a sexual offence
• Registered sex offender
• Court records indicating an open case

Once Lifeline successfully completes my expungement process, how will my record appear?

You may truthfully state that you were never arrested, charged, accused, or convicted of a crime. It’s as if the entire incident never occurred. However, there are some exceptions (see paragraph 1).
